We have recently experienced one of the most remarkable and consequential presidential elections in our nation's 250-year history. We also witnessed an extraordinary attempt by the Progressive Left to use the judicial system to prosecute and harass its political opponents and influence the election process to further its agenda.
A Barrage of "Lawfare" and Corruption
During a recent briefing hosted by the Constitutional Coalition, special guest John Sauer described his role as President Trump’s attorney arguing the presidential immunity case to the Supreme Court. John shared his insights into the Left’s lawfare strategy and the profound test it has posed to our Constitution and the Rule of Law. He observed, however, that the Constitution withstood the challenge in Trump v. United States, and the Supreme Court held fast to the principles upon which it was founded. In its decision, the Supreme Court cited arguments from a joint amicus brief submitted by the Constitutional Coalition and John Ashcroft.
In other examples of the Left’s efforts throughout the election, Colorado and Maine Democrat Secretaries of State went so far as to remove President Trump from their state ballots. In this height of arrogance, these partisan politicians presumed to themselves the power to remove from a state ballot, and deny several million citizens the opportunity to cast their vote for, a lawfully qualified candidate. The Supreme Court unanimously overturned the Colorado Supreme Court’s endorsement of this action in Trump v. Anderson.
In yet another nefarious tactic, Biden’s Attorney General, Merrick Garland, ordered states, including Virginia, to keep the names of illegal migrants and other non-United States citizens on the voter rolls. In the ensuing lawsuits, the Supreme Court overturned the lowers courts and allowed Virginia to remove the names of these non-U.S. citizens (i.e. individuals who are not eligible to vote) from the voter rolls. See Beals et al v. Virginia Constitution for Immigrant Rights and United States v. Virginia.
Finally, consider Biden’s Executive Order 14019 directing federal agencies and federal employees to coordinate with left-wing groups such as Black Lives Matter to register voters and distribute and harvest mail-in ballots. This Executive Order was written by the George Soros-funded Demos group. The United States House subpoenaed the Biden Administration for documents detailing the federal agencies’ coordination of this get-out-the-vote effort with these groups, but the Administration refused. In a similar Freedom of Information request, the Biden Administration also refused to produce documents concerning its collaboration with third-party groups in this scheme. Even though the Biden Administration is legally required to disclose the subpoenaed and requested documents, it has refused. Missouri and other states have sued to have Executive Order 14019 declared unconstitutional in Missouri v. Biden. The Constitutional Coalition is contributing legal research and support in this case, which is now in the Court of Appeals.
All these efforts (and many similar efforts) by the Progressive Left were an attempt to gain and retain political power by corrupting our judicial system and election process. The implicit premise underlying the Left’s strategy is a recognition that the only way the Left can implement their political agenda is by deception and manipulation of election outcomes.
Continuing the Fight
On November 5th, the American people resoundingly and overwhelmingly rejected the extreme, radical agenda the Progressive Left sought to accomplish. Our Nation withstood the assault upon our Constitution.
